Hi team want to see want people think is fair in this situation before I respond,
I renewed a contract with optus on Tuesday got a new phone, selling old phone on gumtree. was about 3 months old (bought it replacing a broken phone) was a grey import phone, came with box and accessories and the warranty card. It was a galaxy note 5. Great condtion. not brand new but very good condition.
guy comes to look at it, takes is time, he was abit annoying, looks over it then wants to connect it to his pc see if he can connect it, not sure why it al connects phone, spends about another 10 minutes looking at the phone in the settings etc, has another quick look around the phone before paying me and taking it. Said if had any problems with the phone I.e faults he asked if he can contact me I said yes if there is any issues you can call me with in the first few days. (in my opinion this means faults hardware or software, if the thing doesn't charge or speaker doesn't work, battery fails or wont turn on or similar issues)
Now he rings me this morning saying I want to return it there is a scratch on the rear glass and some very minor ones, I say to him there were no scratches when I inspected it while resetting it last night before you came. He says there is and I ask for him to send me pictures. He said to me I want my money back we agreed if in first few days if any issues he could call me. I said to him now that's if the phone is faulty regarding software or hardware. I then said to him you inspected the phone for 20 minutes looking over it. Your were happy to accept it as is in the condition presented. You had plenty of chance to see the scratches and if you weren't happy with the marks on the back you didn't have to buy it...if you have missed the scratches on the back you have now noticed that's not my fault. He just proceeds to say he is not happy with it and wants his money back. So I just said send me the pics because I don't think there was anything. I also mentioned you realise this is a 2nd hand phone and is not going to be 100% percent perfect! If you want perferct buy a new one which he just again says no I want my money back. I sold it for $680 so it wasn't an unreasonable price either.
so he sends me some pictures through and this is what I get. The first picture is in regular room bright directly under the light. Even when you hold the phone up close you cant see anything wrong on the back.
this is the type of light I used when inspecting it right before I sold it, I had looked at it couldn't see anything major that stands out. In the ad I put it was in good condition, there is no dents or scratches on the metal frame or on the glass on the front and screen.

he then sends me these two pics, he has obviously taken like the flash on his phone as a torch and is shining it right up close to show up any minor imperfections he can possibly find. These things you will never see in regular day use.

to be honest im not even sure they were even there when I gave him the phone and maybe he has done this since he took it, the guy seemed very very fussy when he came round, he should of just bought a new phone. Like I said he had ample time to inspect the phone while he was there, the physical side of it, he was happy and handed over cash, obviously hardware and software I said yes to him to call me within the first few days but when you go to look at something you can easily check the the physical condtion of it before you take it. he wa happy so he pays me/My opinion he inspected the phone was happy with the condition and took it, if he has missed something he doesn't like upon inspection how is that my fault? its his responsibility to inspect it to a level he is satisfied with before he hands over cash, which at the time he did, I don't see how he can take it home then go over it with a microscope then say nah I don't like it. if anyone thinks otherwise let me know with how I should respond or if im not being fair?
