before anyone gets carried away and starts flaming me (fozzy)
can i get your thoughts on this matter because its absolute bul****

this police officer that keeps harrassing me
followed me round all last nite
i was drivin down the freeway 900 metres in front of my mate in the right lane

i saw a police vehicle flying up behind me
to which i was doing 80kmph as posted while he flew up behind me
he pulls me over and tells me i was doing 114kmph in an 80 zone
i asked to see the gun and he goes no we speed checked u
i replied with there is no way you could accurately determine my speed from flying up behind me when ur accelerating and im doing a set speed
he said we got u back when u were near ur mate
i know he wasnt within a km of me at this time and i was doing only 80
yeh he insisted i was doin 114.

i had had many previous incounters with this officer who i know has a grudge against me. so i told him im sick of him harrassing me and making up stuff to try and do me coz u dont like me

i told him to write the ticket and ill see you in court
he argued further so did his partner for like 30 minutes

there is no way he can accurately determine my speed from 900metres away

he made up stufff about the lightploes being a certain distance apart. i told him there is no way i was doing that speed and there is no way he can judge my speed from 900 metres away

he gave me the ticket and i said ill see him in the courtroom

no offence man but this guy has taken it too far
i know there are cool officers out there like dan and giddyup
but this guy is an absolute fool

and after he gave me the fine he continued to follow me around all night ...wherever i went him and his partner followed.

this guy regularily drives past my house
he regularily follows me home and pulls me over


PREVIOUS ENCOUNTERS

11 months ago

i first met this officer when i just got my chrome 19's 11 months ago
and he wanted to know how i afforded this car and where i work. so i was honest with him and told him i am a cultural heritage consultant.
he asked if i was an aboriginal person to which i replied yes.
he then tells me the plates creepin could not be found on the police computer and they are fake to which i presented the right to display certificate. he makes me sit there for like 20 min while he background checks me. of course back in those days my record was squeeky clean
then his parting words were and ill never forget them "when we catch you street racing we will have great pleasure in taking this car off of you"

i never saw him again fo 11 months the night of my courcase

14 hours after my courcase on a friday nite he saw me driving on leach and he actually (as quoted by himself) "flogged it down the backstreets to beat u home"
accuses me of speeding home when i was doing 60,
i did the measurements and i had to travel 1.5km to my house and i was doing 60
he had to travel 2.6km to my house via the route he described
how fast must have he been going to navigate corners adn 2 red light and arrive at my house 10 second after me
and what was his reason or suspicion to do this, ****ed if i know obviously a personal grudge because of the previous encounter 11 months ago and the fact that i won the case
he questions me on my courcase i went to knowing full well the outcome of how it went, he threatens to give me a sticker, quotes "i can guarantee we will see u in a courtroom again"

the following friday after the courtcase he speedchecks me all the way from freo to maccas where i get sumthin to eat then he dissapears
then he waits down the road on the road that crosses with my street
pulls out and tells me im doin 74 in a 60 zone when i saw him from 500 metres away and did 60 on the dot past him (again no radar gun and speedchecks within 100 metres)then argues that my car is too low(when i passed the pits the day before)


what a tool
he always argues because he knows i am correct
his partners have never said much because they know he is bluffing

so this time i let him write a ticket which i will defend in court
114 in an 80 zome is 4 points and a $250 fine

and the most coincidental part of this is that he made sure id get a fine of 4 points because he knows i only have 4 points left
is that suspicious or what?

this guy obviously thinks that a speed check is where you fly up behind a car and whatever your top speed is to catch the car you are speedchecking is the speed that they are doing.

does he think he is einstien to calculate my speed? coz it would be near impossible to do from 900 metres away
he told me that they were doing 114 to catch up to me in an 80 zone
now if i was doing 80 as i was of course he is gonna catch me at 114kmph
what an absolute tool of an officer, this guy should go back to year 10 maths and learn about triangles, angles and distance

on a positive note i rang the police station he is from at 5:30 this morning , asking to speak to a duty officer or officer in charge, yet his partner answered and was very helpfull to tell me when the senior segent or highest ranking officer from the station was coming in to the office, when she asked who was speaking, i told her and i could tell by her voice she froze and said oh ok.. thankyou good bye... and she couldnt hang up the phone quick enough.
sounds like a bit of guilt to me, coz she knows they never had a chance to determine my speed properly

on another positive note an officer that has pulled me over in frematle several times and been very polite and helpfull to me has advanced from senior constable to sergent which i was happy about because he is a great officer and does his job properly

it shows not all officers are bad
just like everything in life u get good and bad
but we dont need those few bad cookies with all that power
its a shame but what can u do

fingers crossed i can have the fine lifted because i cant b bothered wearing a suit to go to court again. if not i am hoping the judge will throw it out

and if worst comes to worst im sure one of u kind folk will drive my car around for me for 6 months

thats creepins life story for police harrassment so far

i know i wrote alot but i had to get it off my chest

Best thing you can do is take all the info you have on this saga, to the Police ombudsman. If they believe its necessary, an investigation will be launched and you may see a conclusion..

Hey Creepin,
I admire your patience with this cop ,sounds like your doing the right thing by not "arking up".It sounds like he is trying to push you to do something you would regret so yeah keep playin it cool and do as balistic said and also take down his badge number.

A well known dragracer who i wont mention his name allways now carries a hand held recorder due to same type of harrasment.
But you must advise the cop as soon as he walks up to the car that you are taping him. His harassment virtually stopped as soon as the cop realized this evidence would be used in court. But remember! You must tell cop he is bieng taped or i think you will get busted for taping him. Oh yeah have your voice sayin " before you say anything ,im recording this for future refrence due to my police harrasment" or similer so if the cop says" i didnt know i was bieng taped" and trys to bust you for taping him ,at least you will have on the tape you advising him

most monile phones these days can do the taping for you.

he's obliged by law to provide you with his officer id number, name, rank and station....make sure you write these down in front of him, so he knows that you'll be holding him personally responsible.

i didnt read all of your post....but i did read the first section regarding the speeding fine. he needs a gun reading to nail you. thats it. not a speedo reading off the car, and certainly no "light poles are 10m apart, we can accurately calculate your speed to the kilometre whilst we're driving by timing how fast you're passing light poles".

police ombudsman is there for a reason - use him. or else, find some legal rep, take him to court, and then when the judge throws it out, nail him for court costs - then take all the other harassment to the ombudsman.

yeah Ive always thought about the taping thing.

Some cops are alright. I like my local guys.. they pull me over a lot, but have never actually yellow stickered me. They always say ".. fix that zorst.. or we'll sticker you next time"

They know my car very well and sometimes follow me for a km or two.. but never anything silly like that

Make a complaint to the Police ombudsman. As a person of aboriginal descent, you'll probably end up owning his house, car, land, and wife.

This is the reason why I keep a voice recorder in my car. They are very hesitant to stretch the law when they know they are on tape.

Unfortunately, every right.

Police are now able to do random licence checks, which is a nice way of saying they are allowed to pull you over anytime they like, take down your details and ask you whatever they want to.

tell them you wish to have a lawyer present because they wont allow you to tape record the event, that should scare them a bit, although, for a minor traffic offence it would seem a but silly.

Yeah thats another thing, tell him you wish to speak to his superior officer.

Also remember you only have to give a name and address, nothing else, unless they have 'reason of suspision'. If its a random licence check or what ever, just say name and address and tell him you dont wish to comment further, they should just get pissed off and go away thinking you know the law as good as them, and that you are right.

there are heaps of good cops. But there are few that act like this. Especially if there off duty and still act like arseholes. The best thing to do is to take it to court and make sure you bring a map with you. Present him with it and tell him to show the path he had to follow to get to you. It will show he was speeding, just prove to court that he can lie and u'll be all good after that. Ive heard of many ppl fighting this type of situations and even one mate won against a cop with a radar gun. How good is that!! Kick the fuker outta the force.

My cousins bf was a cop, but he got kicked out for a fight with a dickhead one day off duty, but he knows the in's and outs with a few things. If you want me to pass on any questions, let me know. He might be able to help out!!

and every other time a police officer has pulled me over

i have been in a case where i have been court for street racing and caught on tape but i pretty much got off from 12-18 months to 6 months. and there was other stuff on the tape which the cops didnt charge me on and were gonna charge me l8a on but thinking they didnt know i have a lawyer and pin me for everything. but i was advised by lawyer that its all imissable and cannot be used.

moral is cops stuff u around and will pin u if u have not idea of the legal system. so if u get court for nething what eva u do is do not say anything till u have a legal representitive ie. lawyer, legal adviser...

im happy to co-operate with the law, but not when traffic cops views differ to that of the rule books, pits and legal system.... e.g the traffic cop gives u a yellow for having a bov, but when u take it to the pits, they discover its a factory item! waste of your own time and money that is....

learning up on what to do and what not to do is the best defense, standing ur ground for what is right is all you can do.

being a smartass and abusing the system gets you nowhere.....

yeah i got pulled over last night... they just gave me a licence check and breath test, said they pulled me over cause of the type of car i was driving, you have to expect they are going to do this

nothing on my car is legal atm, just had a chat and was friendly to the cops and no problems. i realise is some cases this wont work but you will find in most cases it does.

i had the proper legal document before..and what it says is you CANT record the conversation at the scene of the incident, however you CAN ask for them to take you back to the police station and record the conversation. they have to record it using their equipment.

they ARE required to provide you their badge number, name, rank and all that crap...

i was pulled over 17 times in the first year i had my sil..and around 14 times was me not doing anything wrong...at one point at 3am i was pulled over for nothing, they said i was speeding, i said show me the gun, they said - we dont have a reading but we are pretty good judges of these things. i told them - "i dont feel comfortable discussing this here, can i have this conversation recorded at the local police station" - i actually had the legal docs with me saying this was all legit. they then said "alright off you go, just be careful and dont speed on surburban streets".

you can record it on the scene of the incident, but only if you are involved in the conversation and inform them you will be recording it, ie.. a passenger cant record it.

Well that makes sense to me, I’d expect them to stop and ask what you’re doing.

Since it isn’t a car park and it’s probably illegal (and dangerous) to park in the emergency lane unless you’re broken down. If my car was dumped on the side of the road I’d want the police to stop and check it out. Or if I was stranded with my car broken down, I wouldn’t mind a free lift or borrow a mobile phone from the boys in blue.

Creepin, let ya lawyers take on the fight, sounds like you’ve done everything you can.

If anything they could claim the Police officer was raciest, why else would he want to know if you were aboriginal or not?

Also, unless the speedometer on the Police car was calibrated recently they’d need to give 10% leeway on both speedometers. For example; If you were speeding, you could have been doing 114 km/h but you speedo shows 103. They could have been doing 73 but their speedo was showing 80. The speedos on both cars would be legal accurate to current ADRs. You’d be thinking you were doing 23 over the limit, and their “speed checking” would find you doing 41 over the limit, almost double.

Use this to prove that even if they could have accurately assessed the speed difference between your two cars, then there would still be a huge discrepancy.

They couldn’t have been doing 114km/h to check your speed, because as far as I know a Police car needs approval OR lights/sirens to drive above the speed limit.

That said, I think the ombudsman would be the way to go.

I’m sick of Cops “policing” instead of “upholding the law”, it really does the good cops a discredit.

Funny thing now is that the tax payer is likely to cover all these costs. Police have it all too easy. I would love to sue this cop from Midland Police Communications, but know it won't make a difference to his hip pocket.

cost was $0 as the state had to pay for my costs

i cant go into any other details as yet as to what i get out of it

Harrassment, deformation of character, malicious prosecution, discrimination case is still pending.
however it will be heard in front of a jury.

Not sure if anyone else has replied, couldnt be bothered reading the rest. But no you dont have to tell someone that you are recording there conversation etc That is an american law not australian. I dont know the act (survellience act or something) but the guy i was doing ranger training with was a prosecutor and says he has done this on many occasions and won the cases because of this evidence!

Last I heard from my lawyer was that evidence such as this, audio tapes etc, are usually inadmissible in court....

Transcripts however.... :)
