Story is my current 2 cars are a VZ clubby and a Fd, both not exactly quiet though nothing crazy.

The Girly im currently seeing lives in bateman in a cul de sac with her sisters in a rental. (just moved there about a month ago from the surrounding suburb of winthrop where we never had a problem) I too live in a cul de sac street also in winthrop and never have had a problem

Now this tool of a lady who lives in the cul de sac (not the surrounding houses to the left or right , more opposite the road) has made an complaint about my cars.

I can come in a quite random times granted, (im night owl spec) but i literelly just roll up to the house eachtime yet this lady is being a complete tool, has informed the agency and we got a phonecall about it today. She has previously came to the house (i wasnt there at the time) shouting and swearing and calling me a smart arse etc when im litereally just casually driving in and out.

They will be getting a breach of some sort in writing, is there anything we can do about this? How can they simply get a breach just from some crazy lady making a complaint who is not even a direct neighbour. And if she keeps pressing the point to the agency do have any foot to stand on to kick them out?? very annoying considering just went through all the hassle of moving.

I have the same problem with neighbours over the road from my folks place. they must be close to 70 yet they come out and rant and swear and even start pushing even if I have the car idling during the day. I avoid starting or driving any of my cars early in the morning, or late at night. The same goes for working with air tools and power tools. I drive slowly up the street. I do pretty much everything I can do except move out or sell the cars which is simply not going to happen but they dont give a fuck. anything more than complete silence and they complain. sounds like the same story here. You cant reason with them. The only thing you can do is play dirty. You just have to be very careful about how you do it. remember that they can easily video you or record your conversations. So dont do anything illegal, dont make threats. you have to play it smart. you need to make them realise just how bad it can get so it makes you look like an angel. get a cruise to go past and drop skids but do it while your on holidays. if the cops turn up a few days later you can prove that you werent even there. call her from a pay phone and tell her they will come back every week if you ever hear from her again. they will soon shut up!

Have you/your girlfriend received the breach notice yet? It will be a form 20 breach notice where they will either type or hand write the specifics of the breach. They can refer to clauses within your specific agreement or sections of the RTA. If i had to guess they will most likely use section 39 of the RTA which states;

39 . Tenant’s conduct on premises
It is a term of every agreement that the tenant —
(a) shall not use the premises, or cause or permit the premises to be used, for any illegal purpose; and
(b) shall not cause or permit a nuisance.

The good thing about a breach is that it provides you with 14 days to rectify said breach.

"TAKE NOTICE that I require you to remedy this breach within 14 days of giving this notice."

Therefore if you are able to avoid causing a 'nuisance' for the 14 day breach period they cannot issue a termination notice. Thats my interpretation and has been the interpretation by nearly all registras and magistrates ive come accross.

pretty sure they only have power regarding what happens on the property. the same goes for the council with their noise restrictions with limits on when you can make noise. neither (agent or council) can do shit about noise you make on the street. only the cops can, and by the time they rock up you will be gone or the car will be parked and locked. when I called the council about the noise complaint I received they actually suggested I warm the car up on the street even closer to their house instead of in the garage because if I make the noise on the street there is nothing the council can do.

HAHA nice, exhaust system is a one piece Job, looking at systems at the moment. Plans for the car as it runs out of warranty in April. For a factory system it runs over a dozen mufflers, and under the diff and almost dead straight from the headers....

The last cruise I went on resulted in some "hear the M5 on full song ripping skids".... and I must say when you have a set of 285/35/19..... it certainly leaves behind a decent cloud pretty quick.
