So Ive had a council lady come to my house and state that Im not allowed to do any mechanical repairs on my cars (due to neighbour) complaints she then went on to say that I was not allowed to have an unregistered car on my property I informed her politely to provide me information of what laws im breaking and she could not answer me, she has told me I have 28 days to get rid of my track car as the front of a house is for gardens and flowers. I said you realize the car is parked in the "car drive way" that is not visible to my annoying neighbour (who happen to be a ex canning council member) once again I did not get a direct answer just simply that a letter will be sent out.So these days people are not allowed to use a driveway for a purpose.

Next Rant: Roughly 6 months ago another council lady approached me after the police were called to my house three times about music and told me I have to get rid of my Dj equipment because I am breaking noise rules, yet the police advised me the noise level is fine up to 8pm were levels had to be toned down and 11 were noise had to be minimal, yet my cocky neighbour had some bullshit petition signed and the council forced me to get rid of my equipment or not play music, they are now doing the same with my cars. I have checked there local law bullshit on there website and it states nothing about mechanical repairs to personal vehicles, I called them and spoke to the compliance officer who for the love of god could not answer a single question. Has anyone gone through this and do I have a leg to stand on here because I didn't with my Dj Gear.

There is a clause in the Local Government Act regarding 'disused vehicles' which gives any council the ability to fine you/remove your car if its at the front of the property. Doesn't matter whether its on the council verge or your front yard. The intent is to make sure peoples front yard's don't have car bodies all over them.

As for doing mechanical repairs from home, hobby/personal maintenance or for business purposes, its not a residential land use and is an activity which should be undertaken in an area with appropriate facilities (wash down bays, oil/water separators) and which won't cause neighbours nuisance whether it be noise, fumes etc. Thats what industrial areas are for. But everyone does it, so it comes down to whether you get on with your neighbours.

In both cases, yes they can fine you and prosecute you.

They dont have a leg to stand on. A council cannot force to get rid of personal property stored with the confines of your own land unless it is a) - illegal b) posting a risk to yourself and/or neibours, ie pit of rotten meat.
Edit: may be a clause about visual eye-sore as well... need to check by laws, sorry
They can hassle you about working on your car if they deem it an undue disturbance or pollutant issue, ie air compressors going fill tit at 1am , leaking oil into groundwater drains ect.

Both my Gazelle and 300zx are in decent condition they both are complete minus engine in gazelle but there is a bonnet on it, they are both tucked away into the drive way, I have oil drums that get disposed of legally and only use my air compressor on a Saturday if I need to, I feel there is a bit of a favour going on between one ex council member and this lady that came to my house as the complaining neighbour that constantly films, photographs every single car (mates) that come visit for a drink or to hang out is a retired city of canning council member. I have been told that he is allowed to keep doing that, his wife also has told me I am breaking the rules of the street?

It's possible given that you should be able to demonstrate that its a track car you are using and not a wreck. But the best idea would be to put it in the backyard, tell the compliance officer you moved it, they dw about it for a while, then move it back out.

fwiw canning are a biatch to deal with and generally don't back down with this sort of stuff because they DO have a leg to stand on. I know of cars which have been towed onto the verge and been picked up by sims and people who have had construction materials in their front yard which was all taken to the tip

Had a similar problem at my brothers in cannington, complaining about cars, music etc etc

Then a dude accross the road went on a crack binge assulated his missus with a machate and took his kid hostage (was in the paper), now no fucks are given about cars.

Police said his not breaking any rules, Solicitor said be extremely hard to win a harassment claim against him. I attempted to make a complaint about the 500+ frogs these dickhead breed from there back yard and complained about running the bastards over every winter because they hop from her place accross the road into my swimming pool, made the complaint to council not a dam thing was done.

had people over the road to me try pull this shit on me. it was about my dogs barking but after they called the ranger who i told to fuck off after the first words he said were we have a complaint about your dogs and can take them away from you if you dont stop them barking.i told him i didnt even know they were barking and told him to never call me again and with the guy next door telling the ranger that it didnt bother him one single bit because the dogs only bark when someone is close to my property made him feel that people wouldnt try to brake into his house they had nothing to stand on. after a few days of the phone call they must have been told that there was nothing the ranger could do so the fat little pig came over and said there is some rules we have to abide by. i stood there and asked her to go on she said stop your dogs barking,no loud music,limit people from coming and going after 8pm monday to friday and 9pm on saturdays,also they did not like the fact i brought loud cars home all the time(when i was selling cars) and if i did not stay to these rules they would call the ppl we rent from and talk to them because they are close friends and they would not be plesent towards me or my wife. i just laughed at her wished her a good day and closed the door in her face later found out when i meet the people that own the house we rent they hate those people with a passion and dont care if we piss them off.

sounds like ur neighbour is a right pingpingpingping, go to the shire office in Cannington and get a copy or the shire rules. Go over the rules with a fine tooth comb and find anything, even the slightest stupidest things that your neighbour may be in breach off. Then highlight each paragraph in question and leave a copy in his mailbox. I'd be willing to bet there is more than a few things he is in breach of.

Council spent over $200k on legal fees to get him to remove the cars. He did reduce the number of cars to about 5 but 12 months on he is now at about 15 and a yacht. From the council notes he used the excuse of language barrier (looks Aussie to me). Only 2 adults live in the house, the council notes and meeting minutes are a interesting read if you CBF looking for it.

Most councils have some very retarded rules but they're generally not enforced I'm guessing due to common scene and one of them is you are not permitted to perform mechanical repairs on your cars out he front.

Local Government Acts are all State legislation as I remember, and essentially, the States hold all of the powers not explicitly given to the Federal Government (that Westminster held at time of Federation yada yada). So yeah... Local governments are created by the States, and if Westminster had the power to create them at Federation, so do the States.

I chucked that in as Steve Thomas on www.speedwest.net had an issue with having a race car in his shed on acreage. He has done a bit of research on this subject and there is a couple of threads on speedwest about it.

The guy in East Cannington is on public record at councils website.

I reckon if it is a track car then it is a piece of sporting equipment and not a unregistered car. My 2c

I remember reading something along the lines of this in the local conveyances for Harrisdale when we were building. Not allowed to do mechanical work out the front, not allowed to have a boat or caravan parked out the front. Some shires even go as far as saying what types of bricks and colours your allowed to use.

I dont have the typical in your face asshole neighbours I have the do everything behind your back and come ask questions like why was the council here with smirks on there face.

Another incident were a 70 year old man almost got knocked out by my mate, we were outside middle day on a saturday having a chat when he comes from across the street starts taking photos of there number plates and then has the audacity to come up to my mate and ask if his mrs was a prostitute because she is the only girl with a group of 5 men, all I can say shit didnt go down to well.

I had a neighbour that used to complain about me mowing the lawns and making 'Excessive' noise before 11am on a Saturday like maybe having a radio on during the day. He called the council a few times and they came over and gave me a serve for breaching noise limit (he said i was doing it at 6am, when im not out of bed before 10am and only do gardening like once a fortnight). I had enough after about 3 months of the continuing I walked out the front filled the whipper snipper up with petrol took the exhaust off and cable tied the throttle. Left it on till it ran out of fuel next to his house on my fence.

Havent had complaint since.

Neighbours are fucked.

Friend of a friend that lives in Morley had 5 cars and a couple of boat trailers in his front yard and 6 cars in the back(you could also see the cars in the back yard down his driveway through the car port).

After being told by council to clean up/remove wrecks for ~ 2 years they came and removed 3 cars and a boat trailer from the front yard...dragged 2 cars from the rear of the house, took away/cleaned up a whole buch of panels, parts, drums etc and then sent him a bill of $6800 !!

Dude is a looper with a fuck you council attitude and told them so when ever appraoched .... he`s very upset at losing his valuable car bodies and parts, they also broke his driveway concrete and ran into the carport post ...

look at the old lady in Bentley behind that block of units across from that new park near Leach Highway. her yard was full of rubbish and crap ( she was a long time hoarder, the house was also on TV, the Force or something ), neighbours complained, council told her many, many times to clean up but she didnt listen. council came in with workers and bobcats and cleared the lot, she had no say. not sure who got the bill though. from memory and what was on the TV she may have also been forced to sell the house and it has now been demolished

my boss has had the same shit happen. working on his old falcons, he was paying a hungarian bloke to do all the bodywork on several of them. all during the hours between 9am and 5pm. work was going on for 6months or more.

council came along after a complaint, he just said yep ill keep it down, moved all the cars into the garage or backyard etc. and now only works on the cars in the garage. they also made him clean up all the building materials that were neatly stacked to the side of his driveway. house isnt untidy or anything.

he hasnt heard from the council in over 3 months.

if i were you, id be looking to move. as funny as some of the suggestions are, its likely you could end up with criminal charges if the pranks are serious enough, tresspassing, breaking and entering also applies to roof spaces. its just not worth it.

id also organise an antilag cruise to go past your house.

Well I spoke to a solicitor today and he basically said this, Under there rules I must comply but I can keep a unregistered car on my property providing its for personal use and not a business operation and if they do come take my track car I can claim all lost costs on them and has assured me it is something I can win, Antilag cruise meet up Laconia court Riverton I say

Seems like all council guys are the same. When it's their place and they complain it gets acted on. When anyone else has a more pressing or legit complaint nothing comes of it.
