Here I am thinking cumming on ones self would be the main deterrent for that!

I believe they are valid (since 2000) provided both parties acknowledge all assets, and seek legal advice on the matter and sign.
If this isnt the case a judge can decide what to do.

How do you 'nicely' ask your partner to sign a prenup?

Tocchi
22-06-2012, 05:20 PM

prenup will stop ur partner getting what you currently have it wont stop u loosing what ur going to have. have worked with a few blokes who have been seperated and soon as kids are involved ur fuct. Strongly believe the kids need to be cared/funded for but the way the system works currently is fuct and heavily favours the woman.
An example, a guy i used to work with was divorced one kid 11 years old. He's single still, on about $70k a year with mortgage. His ex-missus has remarried to a bloke who was loaded had a massive property, race cars, sprint cars, own business, F250 truck as a daily, race horses etc. Yet Jono was still being forced to hand over 35% of his wage before tax in child support and his ex-missus was constantly threatening to take him to court for more money.

Kids aren't the problem - muppet females/males are. :-(

So is family trust best way to go? IE. everything then goes to the kids if setup correctly?

Family trust saved my house. Or for even less hassle put it all in your parents name.
And it shouldn't matter what your ex partner is now worth, The child is yours and you need to support them. You stuck your dick in it you pay the price.

Family trusts do provide a degree of protection in the event of a relationship breakdown, however it always needs to be considered in the light of the very broad powers of the family court to look through such structures. The level of protection has been somewhat eroded through recent changes to the legislation, such as the bankrupcy act, where it allows the court to claw back gifts to trusts that were done up to four years prior, sometimes in certain circumstances that period can be extended potentially indefinately.

I suggest you speak to a lawyer, getting legal advice on such matters off a car forum can end in tears lol.
