Was pulled over by an approaching TEG tonight. Officer questioned me as to how fast I was going, to which I was responded I was unsure. To my surprise she then alleged I was doing 75 in a 50 zone (I don't think I was doing anywhere near that speed, at most maybe 60). After they did a random breath test and came back with the ticket, I requested to see the reading from the car. I was told to follow her to the car, and when we get there the officer's partner said he had already wiped the reading so I couldn't see it. Basically, do I have a leg to stand on because they were unable to produce the reading of the alleged speed I was doing?

No. You'll need to fight it in court.

Will going to court on the basis that they didn't produce the reading be worth it?

No. They are under no obligation to show you the reading..

This is the one thing that bugs me about these hand-helds and dash-mounted speed cameras...why do they not retain a log of the readings? It wouldn't exactly be rocket science to have the manufacturer incorporate it into the system - an SD card alone would be able to store a couple days to a weeks worth of data.

ALWAYS deny you are speeding. As soon as you admit anything close to that you where, ticket time.

yeah some lawyers in america did a write up on this issue. always deny everything and only give them information that you legally need to give eg, name, address, licence, breathalyser.

i managed to get away with public urination (i was drunk) because i told the cops nothing and didn't even give them my licence just the number.

Technically, yes. Realistically, no. 2 people against 1, and their words will mean more because they have taken the "oath". They can't prove he was speeding, he can't prove he wasn't. As mentioned he shouldn't have said he was unsure, that's just walking into it

In criminal court wouldn't the onus be on them to prove he was speeding then him proving he wasn't?

Police don't need evidence for speeding. It is not a criminal offense so it wont go through that system at court. Same same for unlawful lane change and so on. Plus the police don't even need a radar to legally issue a ticket. If their car has a calibrated speedo they can speed match and that is enough. It's shit.
You could file a complaint and say that you were not treated fairly and all that. would probably have more chance.

How long does it take for them to get a reading from a radar, a camera and I'm assuming for them to measure it off of their speedo they have to hold the speed for a couple seconds.

With these new cameras - if you spot one 200m-300m up the road and slow down pretty quickly - do you still get flashed?

1-3 seconds once activated i think, if its on constantly, faster read time i believe.

ive got the vitronics manual for the new cameras. im pretty sure 150m is the design limit. any more and it wont read.

I had the same thing happen last weekend 70 zone and it was 90 up ahead. I gunned it and the cops got my speen before i hit the 90. I was doing 103. 30kph over and $700 fine and 5 points. He came back with the fine. I told him it was my right to ask for the evidence i was doing that speed but in my case they took me to the car and it had 103 on one side and 70 on the other. I took it on the chin . They were pissed that i questioned there Authority but sometime you have to do it

I have also heard that they can keep a speeding fine register on the radar and do someone else for the offender before then which is criminal but it does happen

Almost certain that happened to me, didn't even ask to see the speed but claimed I was doing 84 in a 70, when I know I was doing 70 down the hill because my foot was off the accelerator as I knew cops liked to camp in the dark at the bottom. Thought they were just giving me a yellow in my old bunky, came back with that and a fine. Better yet, every single car was also getting pulled over, including one the cop hardly even tried to get a reading for before signalling to pull over /csb

A friend of mine was driving in front of another friend in the same lane, police stopped them both last week. Said they were going 97 in a 70 zone and tried to accuse them of racing.
Ended up writing two tickets and handed one to each driver, with the exact same date, time and speed on both tickets.
I think the same radar reading was shown to both cars (if I remember correctly). Apparently the officer had a worried look on his face when both drivers said they knew each other after that happened.

There's a bit more to the story but I can't remember it all correctly, but they will try and fight it.

No. They were 2 up and their word carries much more weight than yours. Even if you have proof that you weren't speeding your only real option is to argue in court. Not many senior Police will cancel infringements these days without some pretty convincing circumstances.
