View Full Version : Does "Buyer Beware" still exist (so to speak)?

Long story short;
Sold a set of alloy wheels on the 10th of May (6 days ago) to a guy off Gumtree, he came and inspected them, realised that he would need them modified (VE Commodore wheels, need minor mod to suit pre-VE) and I explained that this can be done at home without the need of a professional, as he seemed like the type of guy who would be knowledgeable enough to be able to do it himself.
A deal was struck, wheels were purchased, hands shaken, and he was on his way with a smile on his face and folding cash in my hands.
I've JUST had a phone call from the guy, very irate, claiming that the wheels are buckled and damaged and that he has been quoted a further $260 to repair them.
In a nutshell, I told him that he took the risk to buy them, to my knowledge they were perfectly fine and nearly new anyway (which is true) and the only damage I knew about was listed in the advert on Gumtree.
The guy has made threats towards me, my family and my home, pretty much stating "I will fuck you, and your home" (english isn't his first language, and yes I sold them from home).
Does he have a legal leg to stand on? I wouldn't have thought so.
For my own peace of mind, I've already called the Police and made a report about the situation and explained to them what has happened and what has been said, and the threats he has made.

He needs to suck it up, he bought them fully aware of what he was up against.
As long as you were truthful in the ad and upfront nothing to worry about from a legal pov.
As for him fucking shit up well who knows, he knows where you live which is the worst part.

its the risk you take when buying stuff second hand. only problem is the kinds of people that generaly buy stuff second hand are the kind of people that should it fuck up - wont ware it and will look for any way out...then threaten to bash you etc for their fuck up

He agreed to buy as is, Not your problem.
Keep record on paper of everything he says if worst case scenario, goes to court.

Sometimes a little cash isn't worth the pain in the arse shit like this causes though.
Very wary about selling shit from home especially on gumtree, I try to sell my stuff on forums to known members if I can help it.

Didn't think this guy had any legal recourse.
I've also got security cameras on the front of the house, which will work in my favour. After legal consultation a few months ago, I also now have signage which stipulates that I have video surveillance on the property.

Nope, Indian-type bloke in a Turismo Blue (baby blue) VY Maloo on 22" Pontiac G8 wheels, with a cam and exhaust.
sounds like there is more chance of him kicking your dog. tell him to go fuck himself
tell him you are going away for a while & got a call from someone from gumtree that saw your advert & wants to buy them.
get a mate to call him up & get his address, then its game on!
otherwise just wait & see what happens

I bought a set of wheels and tyres off a guy on forums (Paid $1700 cash)
Turned out x2 of the 4 had slight buckles on it. Contacted mentioned it to him and asked if he was aware and if he would offer any refund (I was doubting) offered $50-$100 back but not a full refund.
The seller stopped answering calls/emails I didn't peruse and got it fixed, at Perth Wheel Repairs for $65 a wheel.
No need for threats, but can see where seller is coming from - but should do as I did and realise they are just second hand wheels, and its a risk you just have to take.

I never use to care gettin people to come to my house in Germain Way Locko, most people were to scared to come into that street, all the natives had my back haha.
If you were honest from the start then tell him to get %#$#$. What ever he does to you give it back 2 fold. Most people give up after they end up in hospital

He deserves everything he gets for buying those.
End of the day, nothing he can do about it. You've already told the cops about threats and mention that you have video surveillance so you're pretty safe. He is obviously pissed at having to fix the rims but that's the chance you take buying second hand and not inspecting properly before handing over the $$$.
If you sold them knowing they had major issues without telling him though, you're a wanker.

Exactly right, however, this is not the case.
My advert on Gumtree was very detailed; listed all the known damage, condition and sizes of each tyre, etc etc. It wasn't a simple "good cond, tyres stuffed" affair.
Just for my own benefit, I've sent an email to the support team at Gumtree asking if they keep a record of deleted adverts, as it would be handy to have a "word for word" account for my advert should something happen - which I already doubt.

Best to think about what you would do if you were in that situation. Surely you would be pissed off in the first instance.
Try to understand where he is coming from, as above, perhaps just offer him part-compensation out of good will.
Telling him to fuck off is just going to make the matter worse. Are you going to fight every person who is dodgy? Why so gung-ho?
What would you do if it was another AL member?

Exactly.
I have had two instances of this in my life. The first was a motorbike, the guy rode it, took it home two weeks later rings me and says its broken and they want their money back.
The second was a portable airconditioner that was working when i sold it, then seven days later after a heatwave guy rings me and tells me it doesn't work.
Both wanted money back, had multiple family members ring me blah blah blah.
In both cases they were working when i sold them and a decent amount of time had passed before they got back to me. Fairly sure in both instances the purchaser broke them.
FYI nothing came from their threats in both cases.
some pingpingpingpings are just shit,
I bought a car that didnt even get me home, called the guy to ask if maybe he had the problem before. nope. no problem. wore it on the chin and fixed it at my own cost, if you're too fucking cheap to buy new you gotta understand that there is risks

I did try and reason with the guy at first, explained that I was not to know that they were damaged. He got irate and agitated, and just refused to take no for an answer. Once it was apparent that this guy was out for more cash, that's when I got defensive and pretty much told him, buyer beware - it's the risk you take.
I even explained to the guy that had he contacted me the next day I probably would have given his money back, but given a week has passed, how am I to know he hasn't damaged them? He just would not understand where I was coming from, which is how things became escalated.
For what it's worth, I actually sold these for less than what other sets of the same wheels sell for on Gumtree, as all I wanted was a quick sale to make room in my garage - I don't have time for his crap.

I had some drama selling my gu patrol on Gumtree,
Was advertised as non negotiable on price, a week after it was up I had some hillbilly from the country cone down for a look. He offered me 4k less than my asking price after I said I was firm on price. He left and calls me a few days later offering me the asking price I was after. We met up a second time to exchange funds and sign transfer docs. He has another look over the car and offered me 2k less than what we had agreed on. I was pissed and told him not to waste my time and left.
Within a week he calls me to apolagize and says he will give pay in full if I fill main and subtank with diesel ($250+ worth of diesel) I said I would consider it, I later texted him telling him I would fill the main tank but not sub and he replied telling me he was happy with that.
Next day we go to the bank and we fill out the forms, he gives me my mOney, I give him the car and shits sweet.
Get a call from him a couple days later, he tells me he feels like he paid too much and would like me to pay the next rego and give him some fuel money, he then starts claiming that he has texts from me saying I would pay the rego (wasn't due for 3 months), fill both tanks aswell as give him my waeco and 4x4 gear that wasn't part of the deal.
He was being all sucky upy until I told him that he wouldn't be getting anything out of me, he then starts threatening me that him and his lawyer buddy will be able to get all this money out and he was gonna sue me.
Knowing I hadn't done fuck all wrong I told him he can try take legal action and then go fuck himself.
He called me a week later telling me he wouldnt sue me if I give him $1k, I loled, he called a week later to give me a final chance to give him $500 or else, I told him to stop calling and to take me to court and haven heard shit since

Being rims and the fact he inspected them prior, I'd tell him to stick it!
My /csb
I had a similar situation this week actually. Long story short;
I had some spare complete assembled heads that came off my old motor and had been sitting since January, I planned to put them on another car but funds have been low lately so decided to pass them on to someone else, they are quite good heads, Ferrea valves, Crane springs and some decent port work, a bargain for the $800 asking price. I had a bloke come and have a look at them, inspected every port and orifice with a little torch, and offered me $600, we settled at $700 and he was on his happy way, and I had some well needed cash. He had been ripped off on his last set of heads which were pretty much cray pot sinkers so thought I'd done him a great deal.
He calls me yesterday telling me he pulled them down to clean them up and has discovered a crack in the intake port, only visible when the valves are removed. I offer to pay half the repairs as I wasn't really keen on the heads back, he tells me he'll finish dismantling them and let me know. A few hours later he calls me telling me he's found another crack in another port and basically wants to return the heads. I was in a difficult position because I sold them from home (A big no no usually for me) and he has recognised me around from my car in magazines etc. so I was pretty much feeling obliged to return them, I was really bummed out, but what could I do? Everybody else told me to tell him stiff shit, but I refunded his money and now I've got unsellable doorstops because I can't justify the repairs.
I believe if neither party knows about damage on the item, which is then later discovered, then as long as the property is returned in the exact same condition as they left then a refund is reasonable.
Nobody is at fault, nobody should be out of pocket, everything returns to how it was.
similar instance to when i sold my VN.
bought it, with no issues, had it for 6 weeks, mate wanted to buy it, i told him a price, he brought his old man around to look at it, offered me a little bit less thsn what i was asking, (only $200 less) which i accepted. dropped it off to his place 2 days later and he gave me the cash. 2 days later rang me complaining about the dash light not working. they were fine when i dropped the car off.... dog prick sends his mother to my work to try and scare me into fixing it. any time i saw him afterwards, he would always complain about it.... until i socked him in the jaw one day and sent him on his way.

legally i don't think there is an issue, but hes making threats and sometimes he might be drunk and decide to come fuck up your shit, just keep all the info you have on him ( hopefully he emailed you first ) and if anything happens to your stuff either report it to the police stating this guy etc made threats ( give details and reasoning ) or had off the details to less honest people and let whatever happens, Happen

After owning 70 odd cars.. Buyer beware is pretty much the only way to go..
Although two of the latest instances have shat me.
First been
Car I brought.. Get it home it's got a big end knock, clear as day
He cold started it then shut it off straight away asoon as I got back.
Called him and said I'll fix it but I'd like 500 back which was pretty much fuk all
Admitted to motor been fucked. Became uncontactable soon after
Car I sold to interstate seller.
Friend in Perth checked out car.
Buyer agrees to pay set price...
Had texts/emails saying so..
I hand in plates to get ready for freight
Friend in Perth then tells him to pay thousand less
Well was either sell or go over pits again
Fucked over 1000 dollars.
I've given people up to 1000 back for small things I wasn't even aware of with cars I've sold
Rather them be happy then call u a pingpingpingping

TL/DR but when ever you sell anything.
1 Write out two receipts stating
What the item is
The date
how much
"SOLD AS SEEN" on both
Get buyer and seller to sign both, keep one copy.
I wont sell anything unless i do this, including high dollar stuff like cars.....
