Well i finally will get a payout for a night that ended badly in northbridge (suprise suprise) that happen in 2010.

They have put their offer of compensation in a letter which is a decent amount, just wondering where I could get some advice/opinions in this matter, I havent seeked legal advice of yet and just wondering if it would be in my best interests to take it further or not (would have to appeal and go through court) and to see if their offer is fair.

anyone been through this before? who did you go to?

thanks.

If it's a decent amount, why not just take it? No doubt the court sessions and extra time associated with trying to increase the payout will chew up resources and delay the whole process where you could use the initial offer to make money or induce happiness..

^+1 If you feel the amount covers and Injuries/Emotional difficulty suffered take the cheque and walk away.

You run the risk of receiving a lower offer it goes too court + as Agitated said the extra time and Legal costs

Would be worth giving legal aid a call just to get an idea if your offer is reasonable or not.

As above though, unless it is well below what you think you should be getting it is a case of diminishing returns, the harder you fight for more cash the more it will cost you to do so.

Definetly call legal aid just to make sure it's fare and covers all your costs.

I was offered compo a few years back.I went to a lawyer, just to check, ended up walking away with a smidge over 10 times the original offer.
I am not saying this will be the case, but if you dont at least ask the question, you may end up regretting it.

Have to be quite blunt.
What happened and how much was the comp payout offer?

Either this (http://www.antilag.com/forums/showthread.php?44447-Who-saw-me-get-attacked-bottled-Metro-s&p=779880&highlight=#post779880) or this (http://www.antilag.com/forums/showthread.php?35167-Legal-advice-(who-where-why))? I'm guessing it's the former.

I had a friend in a similar scenario who got stabbed a couple of times in a home invasion. He took it higher as the original payout was laughable ($15k). Although it took a couple of years he got awarded a larger payout. It was also televised when he won the case. I beleive he also set the case for larger victim of crime compensations.

PM me for details on what you got (to compare his new payout) and if you require his laywer.

sorry for delay response ( in NZ atm) and lol about some of the comments

wasnt stabbed (thats another story, that ill never get to the bottom of)

anyways, long story short:

At a nightclub, got punched in the mouth (real cheap shot, big king hit, wasnt even looking in general direction of the guy) and he chipped 4 of my teeth, as well as your general bruising/cuts etc - Have been told my teeth will need maintenance throughout my life probably as the the fillings will need to be done overtime again. (teeth were chipped at the edges of the teeth so the fillings are fragile and come off - 1 has already a bit) Never met the bloke before, but police did their job eventually and he was found guilty of bodily harm and disorderly or similar at court.

The interim payment was about 420ish (cover my dentist bill) and now offered another 3500 on top.
