Did a search and couldn't find anything relating to the following;
Missus got rear ended (kek!) she has 3rd party as it's her old car. The driver at fault was driving their parents car at the time, so his not insured on it.
So basically, missus can't claim as she has 3rd party, and the dudes not covered so he can't claim I assume. I do have all his details, and his insurance details for the car, the bloke reckons he'll pay up, but I'm just seeing if there's anything I can do just in case he doesn't pay up.
Can his parents claim something on his behalf, I assume not.
Cheers in advance for any advice.
Owner of car makes claim, they cop the excess ?

Even then, an insurance policy is on the car, an un named driver just has (usually) massive excesses involved. Or is he unlicenced aswell??

Car is insured not the driver. Basically the kids parent will cop huge excess for not having the kid on the policy. Your missus will be covered under the kids parents policy because she was hit. Sucks to be the kids parents.

unless there is some restriction on the parents policy regarding who can and cant drive the vehicle, then they should be able to lodge a claim and get your Mrs car fixed. make sure you stay on their case though.

Sooo just in case the person in question doesn't want to play ball, is there an option for legal action? The matter is dragging on a bit.
I was thinking maybe compensation for the car and the legal costs. On the other hand, I'm thinking if he can't pay for the damage, what can a court do to force him to pay it if he actually doesn't have the cash?
I informed him that he could claim the damage on his parents insurance, sent me a message saying he couldn't (didn't state reason), I'm assuming his covering his ass from his parents. I'm just thinking of calling his parents and dealing straight with them, but also have no idea If I'm even allowed to do that.

If it goes to court, they will work out a payment plan with the dude. They can set amounts like 30 bucks a week for the next 10 years or other rediculous terms.

Contact parents direct, they own the car so deal with them. Less chance of being fucked around then, let the parent know you will sue + go to the Police (who cares if they can't do shit just bluff like a baws). Contact the insurance company as well.

unless the kid has a shocker driver history and the company won't cover him.
id go to the parents if you have that link available. after all, it is their car and their insurance :)
they do not have to claim if they don't want to. if thats the case, you will have to fight it yourself.
done a police report?
- call parents or insurance co direct, if theres damage to the other car they will lodge a claim.
- get a quote and write a letter with intention to sue then send it to them
- only thing you can do is spend money on legal costs to sue them but even then you'll get like $10 a week.
- police report is useless, they wont get involved unless more than 3k of damage or a hit and run, they cant make The other person pay.
- what insurance co are they with?
- what actually happened? She got hit in rear but could actually be her fault.

Done a police report, damage to their car was fairly minor though, two quotes ive got to repair missus car are 3k. Their insurance agent is allianz.
Missus was stopped at a t junction, got rear ended. Not sure how its her fault?

check your Thrid party policy, most cover for uninsured motorist, if the driver of the other car is not covered by their insurance co for some reason then your tp policy will cover you. The other person has to put it in writing that they are not covered by their insurance co.

^ +1 When I was insured with SGIO 3rd party fire and theft, they will cover you if the other party has no insurance.
