View Full Version : Need Real Estate Legal Help

Hi I currently am living in a house where 3 people are signed to a lease and one person has moved out and is now refusing to pay a share of the rent.

I need to find out where I stand or what we can do to avoid certain things that might happen. I currently am not even certain as to what will happen.

My current housemate and I are still paying our share of the rent but it will fall behind due to the 3rd persons lack of input.

What should I do?

There could be a number of weeks before a new housemate is found though.
and the person would still be responsible for their share of the rent until they help us find a new housemate because it was them that just up and left.

Responsible or not, you get behind in rent and you are going to recieve an eviction notice...

Pay it, then take her to small claims to recover costs of vacancy, your lease agreement is the binding factor,

Put your requests to her in writing and keep a copy of all corrispondence.

Long story short shes meant to pay up until a new tennant is found..

however, arguing the fact with a small claims court will take a long time to even get before a magistrate..

ideally in a happy world, she would have found a tennant to take her spot before she left, however, people are fuckheads, and up and fuck off like this one appears to of and don't bother getting a replacement in..

basically your going to have find to the extra coin until another tennant is found and cleared by the estate agent, then your going to have to chase the old one through the courts for the cash she was meant to have coughed, make sure you note down ll dates and times of communication with her and what as discussed..

Unfortunately you're all equally liable under the Lease.. just because one person has buggered off, it doesn't mean you can stop paying that portion of the rent.

So its up to you to pick up the share of the rent and then you can attempt to recover it from your housemate.

my sister had same thing in cairns. friend moved out but becuase she was on the lease she had to pay rent for the next 8 months or until a suitable tenant was found, needless to say there was no suitable tenant.

shes fucked mate got to real estate, if shes on the lease its thier problem. same thing is happening to me at the moment my house mates wanna leave but still gotta pay rent every week. so ring reiwa (REIWA) they'll tell ya your rights aswell

Looks like you're going to have to split the rent 2 ways instead of 3. Your old house mate will need to remove him/herself from the lease and sign a form on where the bond is to be payed out when you moved out. This will need to be agreed on by all of you on what % he/she gets. But basically its a piece of piss if one person wants to remove themselves from the lease. I did the same when split from my ex. I was asked to write a letter stating I had vacated from the premises and to sign a form on the release of the bond. It was very easy.

basically you're screwed

No the person can remove them selves from the lease fairly easily as what has already been stated.
Real Estate is only interested in getting the rental money not which tennant it is coming from. In house moaning isn't high on their priority list.
Only thing that will happen is when the property falls into arrears all parties on the agreement will be held accountable, so you may as well get them removed from it and move on.
