Got rear ended today intersection of Leach and Tonkin heading north, it was a guy bout early mid 30s said his name is Joe Condelli, he had E plates displayed so therefore wasnt carrying a licence, rego of the car is 1DJT 569 i rang the police the reg does match the name, but he gave me a fake licence number and told me he was insured with GIO but they dont have it in their database.
Been trying to call his mobile but its switched off.

Car is a White Rodeo ute with bars in the back.

Just wanna know if any one can confirm he hasnt lied to me.

If you have full comp cover on the car, just call up your insurance company now and give them all the details and they will get it sorted.

pursue the guy, take him to court, still has to pay his own excess but instead he will get $5 a month over the next XXmonths until excess is paid for from the hit and run guy

Cops now have the IP address of the fucking pingpingpingping who broke in to my house courtesy of him successfully accessing the NetBank of my sister in law and failing epically to transfer all her savings out of her account then trying again a couple days later after the password had changed - CommBank thought it was suspicious and got on to it ASAP but would not give us the IP address, only the cops.

Sorry to say, but a IP lookup does not take this fucking long, could have found him myself long before now...

If the default judgement is awarded, you can apply for a seizure and sale - the court bailiff will go and seize his assets to an approximate value of your claim, and he then has a certain amount of time to pay your claim, or his assets get auctioned off to pay you out. As long as you can provide an address/location of assets.

Just get the judgement. If he appeals, he has to show he not only has an arguable defence to your claim in the first place, but also a valid reason for not responding to your claim in the required timeframe.

Get the court bailiff to serve him with EVERYTHING - they then write up an affadavit of service each time, so you can say you have done everything by the book, he cant claim "i never saw it" or something like that.

I've been through this situation before, with the car being written off, sending letters of intents with quotes and then organising a bailiff..

Situation like this are so frustrating and makes you wonder about some ppl and their lack of morals. The guy that hit me was shady as, wanted to work it out, then suddenly his phone is turned off, moves house etc

I got screwed in the end, he moved house to many times, but i went through the process of legal advice, courts and bailiffs. Its so infuriating, and you wouldn't be able to sleep at night if you hadn't tried or exhausted all possible avenues of recooperation.
