..because I don't. Basic story:

Since I had my car written off I was thinking about what to do, whether or not to save the money, buy another car or what.
Being a fan of R33's I decided to buy another one, and was looking at buying bouz's & putting my 25 in it, but then he stripped some parts of it so it went out of the equation.

Another 33 I seen up for sale took my interest, so I got in touch with the guy & pretty much told him I'm interested in his car, but I'm not going to waste your time over it, if I contact you about it you will know I'm serious, if not then no bother either way. Then it went like this:

*Made sure finances were all good before committing, but messaged him from work that I wanted to see the car. Sent me one back saying the car was sold.
*Asked when & how much he ended up selling it for, and he said earlier that day from an offer the previous night, for $500 less than what was his latest asking price, but the guy hadn't given him a deposit
*I asked him when the person was going to give it to him or the full payment, just so that if the sale happened to fall through I could still be ready. Then he called me & said the guy was meant to drop the deposit to him at work (on a Friday), but had called him & said it would have to wait until the Monday as his account was skimmed. At this point he said that only if I was seriously interested & would buy it if I wanted it, with an up front deposit, that I could come & look at the car that night. I said I would, and did.
*Had a look, liked it so I gave him a $500 cash deposit, but only after I had said to him that it was entirely his decision to wait for the other guy or not. I knew the price the other guy had offered, but I was willing to pay the price he was asking before I'd even seen the car.


As I had the finances organised already, that went through earlier this week & I paid the rest in cash the other night, and now have the car. Tonight I seen in the thread for that car someone sent him a pm regarding the car, then a reply from another guy that said the car has been sold, to a dog that offered more money & he didn't get a chance to match it. Like I said I didn't offer more money to screw the other guy over, and even gave the seller the chance to just stick with the price he had agreed to, but he knew I would have the money ready....

I don't feel guilty, business is business & no rules were broken. But I can understand it would suck for the other guy to miss out on the car because he couldn't get the deposit that he needed. Thoughts??

ps - I don't exactly care what this persons opinion of me is or will be when he reads my explanation, I'm just looking for a general consensus if he has a legit reason to be pissed off at me or if I just happened to be there with the cash & he didn't :wave:

not your fault IMHO, if hes pissed at someone it should be the seller, irrespective of circumstances.

i would think that it was entirely the seller's decision to make..he received the deposit from you first and it was more than what the other guy had offered..it could have easily ended up unfavourably for the seller if the other guy were to back out for whatever reason as he had not officially put down a deposit yet..it was just an unfortunate situation for him as his account got skimmed at the wrong time
i think the only person to have an obligation to the other buyer would be the seller and not you imo as he has a responsibility to honour his promise to the other buyer so just chill and don't worry too much about it..things like these happen all the time..just my 2c worth

if i was the other dude i'd be pissed at the seller. it's a pretty shit thing to do. if the other buyer was late getting a deposit together because he was just slow then fair enough but if it's because the account got skimmed then it's not really fair play to give him the arse.

but meh, i wouldn't lose sleep over it. you've got the car you wanted. where are the skid pics?

In the message I've sent the guy I also said not to be mad at the seller either. From his perspective he had guaranteed cash from me, or he could have waited for this guy the next week. But if you can't come up with a $500 deposit what's the guarantee he will come up with an amount a lot more than that? I think that's what he thought, but I did give him the option.

I'm not going to lose sleep over it lol, just wanted to get some thoughts, only cos I don't like being called a dog by someone thinking I've deliberately made out to screw somebody over :p

Skid pics will be on their way, don't worry about that :D All tyres are Federal's, which I hear smoke up nicely!

I had an episode like this when I was selling my levin.

Took me over 12 months to sell it, a guy said he wanted to look at it in a couple of weeks and to HOLD IT lol in which I said yeh no worries (I dont hold shit)
3 days later the car got a buyer and I just needed to get rid of it at that stage so I took the cash and the car was gone.. Then the guy who wanted me to hold it sent me a really pissed off email that I should of held the car because it was my word!

When it takes that long to sell a car.. cash talks imo.. if you got the cash come and get it

I'd be pissed if I was the other potential buyer.

I had a similar thing happen to me but it was for a dump pipe and I was waiting for the seller (who had agreed to hold) to get a postage quote (had to wait 'til Monday, it was a weekend) so I could dump the funds in to his account and then he sold it prior because the another guy just threw a tonne of money at him. As annoyed as I was, it wasn't anything to lose sleep over as space said.

dont worry about it man my calais was sold at a car yard in wangara but the other persons fianance kept falling through so i turned up with a deposit one day and it was mine! and now ive had it close to 3 years.

Money talks. I wouldn't feel bad if I were you, you had the money to take the car there and then, he did not.

Besides it's not like this other guy won't be able to find another R33.

dudes a dick, if anything should be pissed at the seller, not your fault, was up to the buyer to let the other guy know he had recieved a better offer. nothing to do with you, money talks, fromt the buyers point of view he doesnt know if that other dude was just a time waster and when you rock up with the deposit and a better offer its hard not to take it, maybe should of let the other buyer know, but meh...nothing to do with you.

Since I knew this story before names started getting called, before you even brought the car, it is 100% not your problem. You had money ready, the other guy didn't. Smart business is never letting a sucker keep his money :lol:

How do we know the guy's account was skimmed? How does the buyer think he's going to produce the money when he can't offer a deposit? A contract to sell can only be formed with an offer in writing signed by all parties involved or by offering a deposit. Doesn't have to be $500, could only be $20 just to hold the car for him. I guess if the seller doesn't want to accept $20 as a serious deposit than that is just tough shit for the wannabe buyer.

If a deposit wasn't put down then its not your fault, when I sell my cars and they dont put a deposit down I dont hold it for them, how do you know if that buyer isnt still going around to look at another car and find a bargain?? so pretty much if that bloke wanted it he should have atleast put a deposit down and signed papers..such is life

Haha when I purchased my car, I was told that a young guy was wanting it and was coming back with his dad the next day to buy it. I was there the next day at 11, made the purchase and as I was getting into the car the young bloke arrived and broke down in tears out the front of Fabcar.

I hated myself... for the 2 seconds it took to get onto Albany Highway and hit boost.
