Ok so there is this club called Double Lucky in Leederville. It's not that great by any means but as I work in the area it is a frequent Friday night hang for work colleages. However it has a restriction that you have to be over 25 to enter, which as I am 23, presents a problem.
Does this count as discrimination? I really don't see how they have the right to discriminate based on age.

not entirely, theres a whole discrimination thing.
even if it a private place and you said no blacks/muslims/serbs/greeks/macos etc. im sure someone would kick up a stink.
frankly i get rather pissed off everytime that stupid fuckign RAC add is on, that, "rewards women for their safer driving"

Tons of things in life are based on age - insurance premiuns, health insurance, etc etc.
Its the same as The Avenue in Claremont - over 25 generally.
Rock up one night dressed nicely and have a good attitude and youd probably get in anyhow.

what i mean is, is it a guideline, or an enforcable law type deal? if your under 25 you can get kicked out and banned etc?

I remember somewhere in the valley (brisbane) bringing in this rule. all sorts of people tried to fight it, but, i dont think anything ever eventuated. I used to go there a fair bit, and the change of atmosphere before and after the restriction was fucking huge. no more 18 going 40 power drinkers with an attitude, no more jailbait (well that wasnt really a good thing to lose, but the 18 year old power drinkers trying to impress said jailbait were never missed). Although 25, i thought was a bit of a weird age cut off.... maybe 21 would of worked a little better. I know my drinking/drunk behaviour between 18 and 21 changed heaps.

Nah its certainly not enforcable by law, but at pretty much every night club you will see the following sign somewhere
"management reserves the right to refuse entry"
They can refuse it for any reason they wish..

if its a private club with members etc, they can set their own rules, but if its a public bar, they have to follow Liquor Licensing laws. Laws state ANY person over 18 permitted.
Can only get around this if they have a License to raise the minimum age limit. But as you said, its not that great, so pick a new watering hole.

You could try and claim discrimination on the grounds of age in the provision of goods and services, or access to places, under the equal opportunity act. But to be honest I don't see that it will really achieve much... if the complaint is upheld by the commission (which in all honesty they are pretty useless), is it really worth it to go to a place you don't really like anyway? All the same you can try, that is if there isn't a provision in another act that allows them to do it.
Clubba in Claremont had a little bar next door with a similar resrtriction.
Gents 25 whilst no restriction was enforced for females. Im confident the same owners, (hutchy, Prendy etc,) are involved.
Bottom line, it does sound harsh and by all means it does shout descrimination but thats night clubs for you these days.
Yeah thats The Avenue. Hutchy has apparently sold out after a couple of things, but I suspect its more the case that he has removed himself from being a public shareholder.
End of the day you go to a club and you get denied because you havnt got a collared shirt or dress shoes, this isnt that far different.

being over 25, i hardly call my self past it, infact keeping out under 25's is a bonus. IQ would double instantly. :)

It's totally different. I could wear a collared shirt and dress shoes, but I can't change my age.
As I said, it's not that great but a pain in the butt if everyone you are with wants to go there. Wow I do bear a grudge don't I? hahahaha
AGE DISCRIMINATION
It is unlawful under the Equal Opportunity Act 1984 to treat a person unfairly because of their age.
Direct age discrimination occurs when a person, because of their age or the age of a relative or associate, is treated less favourably than another person in the same or similar circumstances.
Indirect discrimination is when a requirement, condition or practice that is the same for everyone has an unfair effect on someone of a particular age, and is unreasonable in the circumstances.
Where does the protection apply?
Under the Act it is unlawful to discriminate against a person because of their age in certain areas of public life, and they include:
*Employment
*Education
*Access to places and vehicles
*Provision of goods, services and facilities
*Accommodation
*Disposal of land or estate
*Clubs
*Sport
*Application forms
*Superannuation schemes
*Advertisements.
Exceptions
There are some instances where it is not unlawful to discriminate against a person because of their age and these include:
*Domestic work in private households
*Accommodation in private households
*Payment of junior wages when prescribed by an award or industrial agreement
*Mature age admission schemes offered by educational institution
*Bona fide benefits or concessions provided to someone of a particular age
*Where the terms and conditions imposed in relation to employment, access and the provision of goods, services or facilities comply with reasonable health and safety considerations
*Offering voluntary retirement to someone of a particular age
*The retirement of a judge, master, district or family court judge, magistrate or stipendiary magistrate, president or commissioner or solicitor-general
*A contract with a minor if that contract is unenforceable at common law
*Measures intended to achieve equality
*A genuine occupational qualification
*Acts done in compliance with a written law of Western Australia
*Superannuation and insurance, if based on reasonable data and statistical evidence
*Disposal of land within a residential complex intended for persons of a particular age, for example in a retirement village
*The provision of charitable benefits
*Admission as a member, and benefits provided to members, of an unincorporated body
*Establishments providing accommodation for aged people.
If an individual or organisation relies upon an exception under the Act when a complaint is made against them, they must justify the use of that exception to the Commissioner for Equal Opportunity.
Examples of Age Discrimination
*After being asked for, and providing, her age during a job interview a woman did not get the job because the employer said he wanted a younger person for the position.
*A restaurant advertised it would not serve children under 12 years of age.
*A 22-year-old’s application for a bank loan was refused and when she asked why she was told “…because people under the age of 24 are financially unstable”.
*A car rental business refused a car rental to an 81-year-old woman because the company’s insurer would not insure a driver over the age of 80.
*An employer refused to consider job applications from people over the age of 40 because “... they can’t learn new skills”.
*A couple and their 12-month-old baby were denied access to a restaurant because the manager said the baby would disturb other diners. The couple lodged a complaint of unlawful discrimination on the ground of the age of a relative, their child.
Agreed with the above.
So what next, make a complaint, maybe go to the tribunal, win, force them to let you in, go down, where everyone working there is going to know who you are, and then you get treated like shit and you wont want to be there anyhow :)

Nah thats the slow way, just threaten them with taking it to the media. Everyone hates bad publicity and the number of times ive successfully used it with companies that have blatantly done the wrong thing by me would surprise. Keep asking to speak to someone high up enough and just come across in a way thats crazy enough to actually go to the time and the effort to make life hard for them and they usually give in as it isnt worth their hassle.
But like someone said before, would you really want to go somewhere that you arent wanted anyways? I understand that its a violation of your rights but theres plenty of other clubs/pubs, i wouldnt get worked up over it, just be best to move on. If you have a bone to pick then yes you definately have legal grounds and different avenues in which to pursue them.
At the end of the day i would just say "fuck this place, im going somewhere that wants my money for a few beers"
You can find top chicks at most other places.

I went to over 25 bar on saturday, called Devilles pad on the eastern end of aberdeen st. I'm only 24 and some of the chicks who came with us are 21 and nothing was said. i guess it comes down to the place as to how strict they are.

Devilles in new, so i think they are being a little lenient to get the word out.
Pretty nice place from all accounts.

When you are over 25 you will appreciate places like this. Most are relaxed if you look the part, just trying to keep the dickhead factor low. As TJ said, they can refuse entry to anyone if they wanna be pricks.
Hell who hasnt been refused entry to a club because "sorry private function" etc.. hell me and a bunch of mates organised with abunch of girls to meet at the giesha about 18 months ago..the girls arrived about midnight and sent me a txt saying meet us inside. us 4 guys arrive and the doormans says "not allowed in without a girl each" WTF!!! we were like " our girlfreinds are already inside, and the bouncer didnt give a fuck(wouldnt even lets us in if we slipped him a 50!), we called the girls, they came out, we went elsewhere while telling the bouncer he just lost the club a fair bit of cash as we had planned to stay there till we got hammered then head back to one of the girls places in leedy. Bouncer didnt give a toss... i dunno wtf hi sboss had told him, but now it seems age means nothing and just have to have a pair of tits to get in.(so nothing changes there :naughty: )

And if you wanted to go through with it you'd probably win a discrimination case. There just seems to be a growing number of clubs that outright discriminate. It's probably a case of HTFU but when all you want to do is spend your hard earned there and have a good night with mates and you're refused entry based on something you can't change, it's just a sour taste to a night that's not needed and not deserved.
I dare say it's a symptom of the population increasing more and more and there being a lag in the number of night spots...wonder if they would treat customers so readily if the situation was reversed?

devilles is a top place went there a few months back for a party, and no dickheads, the staff were frienly and no one even bumped into you.
maybe I'm getting old but northridge is a dump.

i reckon you should just ask to speak to the manager, explain your situation, ie that your work colleagues regularly come here after work and you'd like to join them
i can't see if you asked him politely why he wouldnt' make an exception
it's not like your gonna rock up there with 10 of your rowdy mates
