Driving Under the Influence Laws

Hey all,

I've been trying to find some info on this, but no luck so far so i thought i would ask here. Everyone knows the legal limit is .05 for your blood alochol reading, and if you blow inbetween .05 and .08 on your first offence its only a 3 point fine and some cash. If you blow over .08 you lose your licence for 3months and if its over .15 its lost for 6monthst (all first offences).

Now what happens if you get done AGAIN for driving under the influence, ie .05-.08, ie your second offence for driving under the influece. I heard its not a simple 3 point fine, but since its your second offence you lose your licence, is this true??

hmm i was always under the impression theyd give you your suspension in court, whether you were between 0.08 or what ever...cos ive had mates thats blown 0.1 and been done for 7 months, but he was doin 10kmh over too.

while on topic anyone know what happens if you refuse to do a drug test?

i cant help you out but have also heard that if u are on your p's and get done for drink driving. then for 2 yrs after u get ur license back wether you are still on p's or not the limit is still 0.02%. i told my mate he was an idiot but then 2 days later i got pulled over and breath tested. upon getting a reafding they asked if i had been done before (which i have). remembering what my mate said i said nah i hadn't. dont see any other reason why they would of asked.

does any one know if this is true. if it is its bs that they keep it a secret and it isn't common knowledge?

if you get caught the 2nd time automatic suspension/court appearance i think

so youd rather refuse the drug test and cop a fine and a license suspension, than copping a fine, license suspension, and a drug offence

exactly what i was chasing, thanks mate. I had a feeling it was a suspension, but was hoping it was only 3months for his sake.

EDIT: it is only a 3 months suspension, you must of been looking under the over .08 section.

i believe that you are allowed to refuse...

thing is, they have power to take you into custody, back to the station and do one there if they reasonably suspect something is up...

Is true, guy at work had it (got caught 3! times) only recently finished the 0.02 period.

i got done on my p's blew .16 and more at the station. dumbest shit i've ever done. gotta be a clown to drink and drive eh. won't bother makin excuses for it either, just plain stupid, hah. gotta learn sometime, glad i atleast chose an area with no houses etc to swing skids in the corona so no one else could get hurt...

wouldn't dream of a second offense, and i'm quite stern on others aiming for their first now that i've been done, albeit years ago

id like to go on record saying i blew 0.034 on my P's. over the limit but pretty much sober. if i wasn't on P's they wouldn't of cared.

and thats bullshit that they keep the 0.02 rule for 2 yrs after a secret. I wasn' told that when i had my hearing.

Bloke at our work has been done some insane amount of times 4 - 8 cant remember exactly how many but he is not allowed a liscense anymore. He's a dodgy bastard aswell
